Universal opt-out compliance
Civic Forecast supports the IAB Global Privacy Platform (GPP) and complies with recognized universal opt-out signals, including the Global Privacy Control (GPC) and MSPA Technical Specifications. When a compliant signal is received from your browser or device, we automatically:

Acknowledgment
These Terms govern the use of the Civic Forecast website, products, and services, and the relationship between you and the Company. They apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms; if you disagree with any part, you may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service. Your use of the Service is also conditioned on your acceptance of our Privacy Policy, which describes how we collect, use, and disclose your personal information. Please read it carefully before using the Service.
Links to other websites
The Service may contain links to third-party websites or services that are not owned or controlled by Civic Forecast. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services, and we are not liable for any damage or loss caused by your use of or reliance on them.
Civic Forecast works with providers who may also collect and store consumption data to improve the user experience and app features, using information such as unique device identifiers or IP address. This information is de-identified to better protect the privacy of our users.
We strongly advise you to read the terms and privacy policies of any third-party websites or services you visit, including app-distribution and payment platforms such as Apple, Google, Amazon, and Roku, where you may find their terms and conditions.
SMS messaging terms
If you opt in to SMS, we will send a message to confirm your signup. By opting in, you agree to receive recurring automated marketing and informational text messages from Civic Forecast at the number you provide. Message frequency varies, and message and data rates may apply. Your consent to receive marketing messages is not a condition of purchase.

Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
Limitation of liability
Notwithstanding any damages you might incur, the entire liability of the Company and its suppliers under these Terms, and your exclusive remedy, is limited to the amount you paid through the Service or 100 USD if you have not purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including loss of profits, data, or information, business interruption, personal injury, or loss of privacy) arising out of or related to your use of, or inability to use, the Service. Some states do not allow certain limitations, so some of the above may not apply to you.
"As is" and "as available" disclaimer
The Service and our products are provided to you "AS IS" and "AS AVAILABLE," with all faults and defects and without warranty of any kind. To the maximum extent permitted under applicable law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Governing law and dispute resolution
The laws of the United States of America and the State of California, excluding conflicts-of-law rules, govern these Terms and your use of the Service. Your use may also be subject to other local, state, national, or international laws.

For European Union (EU) users
If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
Digital Services Act (DSA) compliance (EU). As a digital service provider operating in the EU, Civic Forecast affirms its compliance with the European Union Digital Services Act (EU Regulation 2022/2065): we provide accurate trader information to platform partners, clearly identify commercial communications, provide clear pre-contractual information and accessible support, maintain procedures for complaint handling, moderation, and lawful takedown notices, and cooperate on audit and transparency requirements. United States legal compliance
You represent and warrant that (i) you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.
Severability and waiver
If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or require performance of an obligation under these Terms shall not affect a party's ability to do so at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation interpretation
These Terms may have been translated if we have made them available to you on our Service. You agree that the original English text shall prevail in the case of a dispute.
Changes to these terms and conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice before the new terms take effect. What constitutes a material change is determined at our sole discretion.
